China: Taiwan arms sale will disrupt US exchanges (AP)

BEIJING ? China's military exchanges with the U.S. will suffer after Washington announced a $5.85 billion arms package for Taiwan, the Defense Ministry said Wednesday, confirming expectations that Beijing would retaliate over the sale.

High-level exchanges, joint drills, and other large-scale activities will be affected "in light of the serious damage" resulting from the sale, ministry spokesman Geng Yansheng said at a news conference open to Chinese reporters only.

That follows a monthslong suspension of military contacts last year after the announcement of another arms deal for Taiwan. China views such exchanges as a political bargaining chip, frustrating U.S. officials who say they are important in building confidence and avoiding confrontations as China's military modernizes.

It wasn't clear whether additional retaliation would be taken.

Chinese Vice President and future leader Xi Jinping is expected to make an important visit to Washington in coming months but no specific dates have been announced. There have also been calls in the media and the military for commercial reprisals against companies involved in the arms package, but China's own fledgling commercial aerospace and other high-tech industries rely heavily on American technical expertise.

Separately, Chinese Foreign Ministry spokesman Hong Lei said U.S. military ties with Taiwan risked "undermining overall interests of bilateral relations as well as peace and stability across the Taiwan Strait."

"We hope the U.S. government responds to China's requests ... (to) stop selling arms to Taiwan, and cease military links with Taiwan," Hong said at a daily news briefing.

China regards self-governing Taiwan, which is 100 miles (160 kilometers) off the coast of the mainland, as part of its territory. The U.S. is obligated under legislation passed by Congress in 1979 to provide the island with weapons for its self-defense.

The U.S. sparked Chinese anger by agreeing to upgrade Taiwan's fleet of 145 F-16s that the U.S. sold it in the 1990s, although it deferred a request to sell the island a more advanced version of the plane.

U.S. officials said Chinese diplomats had earlier told them China would respond by canceling or postponing some U.S.-China military exchanges.

However, the chief of U.S. forces in the Pacific, Adm. Robert Willard, said Tuesday that Beijing was very likely to retain the highest-level exchanges of visits because of their importance to China, allowing the two sides to continue strategic discussions.

The Obama administration has deepened ties with Beijing, and sees the military exchanges as mitigating the risk of U.S. forces tangling with China's in East Asia and the West Pacific. Since May, the U.S. joint chief of staff and his Chinese counterparts have visited each other.

U.S. arms sales to Taiwan have been spurred by Beijing's rapid military buildup and come amid friction over territorial disputes in the South China Sea that have prompted countries such as Vietnam and the Philippines to strengthen their military ties with the U.S.

An editorial Wednesday in the Communist Party's official People's Daily said such moves by the countries were a vestige of "Cold War thinking" that could exacerbate tensions ? combining declarations of peaceful intent with warnings not to underestimate China's determination to defend its claims.

"Some countries think all they need do is draw the support of American military strength to counter China and then do whatever they like," the newspaper said, without naming the countries.

Iraq to buy US warplanes worth $3 billion

The value of the deal was not immediately known, but a senior U.S. military official said recently the offer on the table for the Iraqi government was valued at "roughly $3 billion."

Iraqi and U.S. military officials have said strengthening its air force is one of Baghdad's top priorities as U.S. troops prepare to leave by Dec. 31, more than eight years after the invasion that ousted Saddam Hussein.

"The contract was signed ... and a part of the contract cost was sent to the bank account of the company," said Maliki's media adviser, Ali al-Moussawi.

Lockheed 'pleased'
Lockheed said in a statement it was "pleased by the announcement that the governments of Iraq and the United States" have agreed on the sale. The company added it welcomes Iraq "as the 26th nation to operate the F-16."

The Pentagon said it was aware of news reports that Iraq had signed the agreement but did not immediately confirm and referred questions to Baghdad.

Iraq has long sought a combat jet for its rebuilt air force. The government delayed a planned purchase of F-16s in February to divert a $900 million down payment to its national food ration program to help quell street protests.

Maliki said on July 30 Iraq would buy 36 F-16s, double the number it had originally planned, to shore up its weak air defenses. The OPEC producer has found itself flush with cash this year, reaping windfall profits as world oil prices have remained above budget projections.

The two sides have been negotiating for the F-16 Block 52 export model with sophisticated avionics and weapons in a deal that included maintenance and training, a U.S. military official said.

Iraq is relying on the U.S. military for air support as it rebuilds its forces and battles a stubborn Islamist insurgency. Washington and Baghdad are discussing whether to keep some U.S. troops or military trainers in Iraq beyond the year-end deadline for U.S. departure.

Iraq's two airborne defense units, the Air Force and Army Aviation Command, have only 158 aircraft, including 89 helicopters and 69 airplanes, and about 7,500 personnel, according to U.S. figures.

At present, it has three Cessna Caravan propeller planes equipped with Hellfire missiles but no combat jets, a U.S. military official said.

Joe Peyronnin: The "Shovel-Ready" Debate

Immigration, Social Security and health care were the most contentious issues in Thursday's spirited debate among the field of Republican presidential candidates vying for their party's nomination. Former Massachusetts Governor Mitt Romney put on another polished performance while Texas Governor Rick Perry seemed at times to struggle. Nonetheless, no candidate delivered a knock out punch.

All of the candidates criticized President Barack Obama's handling of the U.S. economy. Governor Perry began the debate by once again referring to the relatively strong Texas economy and jobs creation as the reasons he should be elected president, "If it'll work in the state of Texas, it'll work in Washington, D.C." Former Governor Romney again pointed to his private sector experience and his economic plan as the reasons he should be in the White House. But, late in the debate, former New Mexico Governor Gary Johnson had the night's best line, "My next door neighbor's two dogs have created more shovel-ready jobs than this president."

Governors Perry and Romney, the two frontrunners according to polls, went after each other on Social Security. In his recently released book Governor Perry denounced Social Security as a "Ponzi scheme" and suggested that some of the responsibility should be turned back to the states. When asked about Governor Romney's attacks on his stand Perry seemed to be on the defensive, "It's not the first time that Mitt has been wrong on some issues before...we never said that we were going to move this back to the states." He continued, "We ought to have as one of the options the state employees and the state retirees, they being able to go off of the current system, on to one that the states would operate themselves."

Governor Romney seized the opening, "Well, it's different than what the governor put in his book...There's a Rick Perry out there that is saying -- and almost to quote, it says that the federal government shouldn't be in the pension business, that it's unconstitutional." Governor Perry quickly responded by switching subjects to the former governor's universal health care plan for Massachusetts. The Texas governor said, "(In your book) you said it was exactly what the American people needed, to have that Romneycare given to them as you had in Massachusetts." Governor Romney denied he ever wrote that.

Immigration was a hotly debated subject and it found Governor Perry having to defend his policies. The Texas "Dream Act" allows children of illegal immigrants to pay in-state tuitions for college. Governor Romney criticized the Texas governor's position, "We have to turn off the magnet of extraordinary government benefits like a $100,000 tax credit -- or, excuse me, discount for going to the University of Texas. That shouldn't be allowed. It makes no sense at all." And former Pennsylvania Senator Rick Santorum attacked Governor Perry's overall immigration policy, "I think he's very weak on this issue of American sovereignty and protecting our borders and not being a magnet for illegal immigration."

Minnesota Representative Michele Bachmann, who had a stronger debate performance this time around, went after Governor Perry for his executive order in 2007 mandating that all 12 year-old Texas girls receive the HPV vaccine against cervical cancer. "Governor Perry made a decision where he gave parental rights to a big drug company," she charged, "That big drug company gave him campaign contributions and hired his former chief of staff to lobby him to benefit the big drug company." The governor said he was lobbied by a 31 year-old woman with cervical cancer and concluded, "I erred on the side of life and I will always err on the side of life as a governor as the president of the United States."

Governor Perry stumbled through his only real attempt to go on the offensive against Governor Romney, who he accused of being a flip-flopper on key issues. "I think Americans just don't know sometimes which Mitt Romney they're dealing with. Is it the Mitt Romney that was on the side of against the Second Amendment before he was for the Second Amendment?" Then the governor seemed to lose himself, "Was it -- was before he was before the social programs, from the standpoint of he was for standing up for Roe v. Wade before he was against Roe v. Wade? He was for Race to the Top, he's for Obamacare, and now he's against it. I mean, we'll wait until tomorrow and --and-- and see which Mitt Romney we're really talking to tonight."

It is unlikely that Thursday's debate in Orlando, Florida, will dramatically change the polls. Former Utah Governor Jon Huntsman, who had seen a bump up in a recent New Hampshire poll, may have actually hurt himself a bit with his awkward answer to who he might pick among the debaters to be his vice presidential running mate. His answer was businessman Herman Cain because he was also wearing a yellow tie at the debate.

In the weeks ahead, Governor Perry will have to do a better job of explaining his positions on Social Security and immigration or they may ultimately drag him down. Yet, what the governor lacks as a debater he makes up for in charisma and charm. On the other hand, while former Governor Romney is a strong debater with a solid business background, he is haunted by Romneycare and his history of changing positions on core Republican issues. A lack of enthusiasm may make it easier for President Obama be reelected, provided he makes progress on reducing unemployment and improving the economy before election day 2012.

So, even though it is clearly a two-man race for the Republican nomination, many Republicans still haven't decided who to support. In other words, neither candidate is yet shovel-ready.

SAN FRANCISCO (AP) ? Hewlett-Packard has performed another extreme act of corporate remodeling, firing its CEO Leo Apotheker after just 11 months and replacing him with billionaire businesswoman and political aspirant Meg Whitman. Yet it's done little to convince investors that the company has its house in order.

HP has now removed two CEOs in two years, and the stock has dropped precipitously, shedding $60 billion of HP's market value. Based on shareholder reaction to Thursday's CEO shuffle, more punishment is likely in store.

Mark Hurd was forced to resign a year ago in an ethics scandal, and on Thursday HP fired his successor, Leo Apotheker, after a string of disappointing earnings reports and the botched handling of key strategy announcements.

He was replaced by former eBay chief Meg Whitman, who brings celebrity appeal and the sheen of a dot-com-era star who transformed eBay Inc. from scrappy startup to Internet-auction powerhouse.

The decision was the kind of hasty, headline-grabbing move that Silicon Valley watchers have come to expect from HP as it muddles through a very public identity crisis with an unpredictable board and the hardest job in technology to fill.

It was another dizzying turn of the executive merry-go-round at a company whose legendary leadership issues are straining HP's sprawling technology empire, which includes the world's biggest printer and PC businesses.

Shareholders were impressed by reports that leaked Wednesday about Whitman's candidacy for the job. But those gains were largely wiped out Thursday when fears set in that HP's strategy is still deeply flawed.

It's not what HP had in mind. Swapping Apotheker, who has now been ousted from two high-profile CEO jobs in two years, for Whitman was designed to stem investor fury over a series of questionable strategy moves.

HP's chairman, Ray Lane, said Apotheker's dismissal was caused by several factors.

"You don't deliver a quarter, you don't deliver another quarter, then you make some important announcements that are communicated poorly ? it was incremental," Lane said on a conference call. Whitman was on the call, but Apotheker was not. "Then you have to make the tough call of, how long do you go along with that? Do you help? Do you surround? Or do you replace?"

Whitman is a billionaire who is best known for the decade she spent building eBay and her unsuccessful run last year for California governor.

Her star power could be an asset for a company that struggled to gain credibility under Apotheker, who was previously little-known outside of the business-software world. HP is no stranger to celebrity CEOs. But Carly Fiorina's run at the company's helm, from 1999 to 2005, ended in shambles.

Despite Whitman's success at eBay, she is untested when it comes to running a company that is in as many businesses as HP. Another turnaround effort earlier in her career, at FTD, the iconic flower-delivery company, ended with Whitman quitting after two years and declaring that the company is "not fixable." Many analysts have said the same thing about HP in its current form.

On Thursday, she defended her predecessor's most controversial moves. She said a decision on PC division's fate will be made by the end of the year.

Analysts are mixed about her prospects.

"She built up a one-trick pony, an online auction site, and she oversaw the growth of the company, but we are talking about a situation where someone needs to come in who has a technological background, an engineering and scientific background," said Steve Diamond, an associate professor at Santa Clara University School of Law. "And that is way outside of her skill set."

Diamond said the decision to change CEOs so soon points to continued disarray on HP's board, long a target of critics for the chaos it's caused at one of Silicon Valley's oldest and largest companies. Infighting and ego-driven drama has long plagued the board, from revelations in 2006 that HP had spied on directors and journalists to ferret out the source of leaks, to last year's dismissal of CEO Mark Hurd in an ethics scandal.

"There's no question the board is off the rails ? they need a smaller, tighter board that's committed to the idea of what the company does," Diamond said. "But they have a lot of people on the board from different industries. The tough job will be getting the board on board."

Whitman's appointment Thursday was Silicon Valley's worst-kept secret. Deliberations leaked out a day earlier to the delight of investors, who drove up HP's stock and apparently gave HP's board the push it needed to oust Apotheker.

HP's board met Thursday to finalize the change, having decided that Apotheker had lost the board's confidence in his ability to lead HP long-term, a person familiar with the matter told The Associated Press. This person was not authorized to speak on behalf of HP and spoke on the condition of anonymity.

Lane, the HP chairman, defended Apotheker's firing and Whitman's quick selection.

The board "objectively evaluated whether he was the right guy to operate the business, and we came to the conclusion that he was not," he said on the conference call. "And we chose someone who is a great operator, who executed in her business for years and has a track record of leadership. I can't think of a name out there over Meg that I would pick to be CEO of this company."

Apotheker was also forced to resign from HP's board. Lane's position has been elevated. He was non-executive chairman. He is now executive chairman.

An HP spokesman said that Apotheker, Whitman and Lane were not immediately available for interviews.

Whitman's likely arrival was greeted warmly Wednesday, when investors drove the stock up more than 7 percent on reports she was being considered for the job. But most of those gains evaporated Thursday, when fears set in that the company's strategy is still in need of repair.

Cathie Lesjak, HP's chief financial officer, added to those fears when she disclosed that she isn't sure HP can hit its revenue target of $32.1 billion to $32.5 billion in the quarter ending Oct. 31. She reaffirmed earnings guidance. She blamed weakness across consumer and commercial markets, particularly in Europe.

HP's stock fell $1.18, or 4.9 percent, to close at $22.80 on Thursday. It fell another 7 cents in after-hours trading. The declines were worse than the overall market. The Dow Jones industrial average plunged 391 points, or 3.5 percent, on worries that the global economy is headed for another recession.

Boosting HP's sagging stock price will be an urgent problem for Whitman.

HP's market value has dropped by $60 billion since CEO Mark Hurd was forced out in August of last year over an ethical scandal. Hurd's departure set the stage for Apotheker's appointment as CEO and Lane's appointment as chairman.

Proving she can instill order in a disordered company is another pressing issue.

EBay, when Whitman inherited it, was a star on the rise. HP is struggling with bloat and hasn't decided on a clear direction. It knows it wants to be more like IBM Corp., but has a long way to go to complete the transformation.

Steering a startup through a period of growth is markedly different from running an established company that's fallen on hard times, experts say.

Whitman touted her business credentials on the campaign trail in her unsuccessful California gubernatorial bid. She spent more than any candidate for a statewide office in U.S. history on the campaign ?at least $174 million, most of it her own money.

She became a respected executive for her work at eBay, transforming it from a website with a few dozen employees and less than $100 million in revenue into an industry heavyweight with thousands of workers and billions in sales.

But her record as CEO also includes a lesser-known episode that paints a different picture of her abilities to quell a company in disarray. Whitman's time at FTD in the 1990s was her most high-profile turnaround attempt. It did not end well.

Whitman has rarely spoken about her time at FTD. It's an imperfect comparison to HP, but Whitman was brought in to the company in 1995 by her former colleagues at investment firm Bain & Co. to spearhead a major transformation. She was supposed to stay five years, but ended up quitting after two, citing investors' unrealistic goals.

"This company is not fixable, at least not by me," Whitman wrote in her book, "The Power of Many." She calls her tenure there "probably the most frustrating and, ultimately, least successful executive experience of my career."

Other types of concerns have been raised about Whitman.

She was named to HP's board this year as part of a sweeping overhaul under Apotheker and Lane. They were supposed to be steadying hands. But almost immediately, corporate governance experts began crying foul. They took issue with the fact Whitman's hiring by esteemed venture capital firm Kleiner Perkins Caufield & Byers, where Lane works, was announced a week after she was formally elected to HP's board.

Several unflattering incidents helped scuttle her gubernatorial campaign.

She was revealed to have shoved an eBay employee during a disagreement, which led to a six-figure settlement. Whitman said the altercation was an anomaly and taught her to always be professional. It was also revealed that her former housekeeper of nine years was an illegal immigrant.

To complicate matters further, Whitman was a board member at Goldman Sachs when it allegedly engaged in the now-illegal practice called "spinning," in which wealthy clients and CEOs whose companies did business with Goldman received early access to IPO shares, which they flipped quickly for large profits. Whitman said she forfeited the $1.8 million she made from the deals in a lawsuit she settled with eBay shareholders.

[JURIST] The US Court of Appeals for the Ninth Circuit [official website] on Friday struck down [opinion, PDF] a City of Redondo Beach [official website] anti-day laborer ordinance [3-7.1601 text] as an unconstitutional restriction on speech. The ordinance prohibited individuals from standing on a street or highway to solicit ?employment, business, or contributions? from passing motorists. The city argued that the purpose of the ordinance was to improve traffic safety and flow at busy intersections. Plaintiffs, which included the National Day Laborer Organizing Network (NDLON) [advocacy website], argued that the ordinance was a violation of the First Amendment [text] and prevented day laborers from seeking employment. Citing Perry Education Association v. Perry Local Educators? Association [Oyez summary], the court stated that the city was free to limit the time, place and manner of expression only if the regulation was narrowly tailored and left open ?ample alternative channels of communication.? The court determined that the ordinance failed to satisfy the narrow tailoring element because it regulated ?significantly more speech? than necessary to achieve the city?s stated purpose. The city could achieve the same goals by engaging in less restrictive measures, such as enforcing traffic laws at busy intersections. The Mexican American Legal Defense and Education Fund (MALDEF) [advocacy website], which represented the plaintiffs, applauded the ruling [statement] as a ?strong precedent on day laborer rights.?

Today?s ? opinion resoundingly vindicates the First Amendment rights of day laborers throughout the western United States. The dozens of similar ordinances through out the region that purport to prevent day laborers from speaking on sidewalks are now even more plainly violative of the Constitution. ? The longstanding principle that the right of free speech belongs to everyone has been significantly bolstered by this decision.

The en banc decision reverses a previous panel decision [text, PDF] upholding the ordinance as constitutional.

Rights groups have also asserted the free speech rights of day laborers in their challenge to Arizona?s immigration reform bill [SB 1070 text; JURIST news archive], which provides similar restrictions on solicitation. In January, a coalition of six rights groups filed a petition [JURIST report] in the US District Court for the District of Arizona [official website] seeking to block the provisions, arguing that ?solicitation speech is expression entitled to full protection under the First Amendment.? Last month, the state of Arizona filed a petition for writ of certiorari [JURIST report] with the US Supreme Court [official website] seeking to overturn a lower court decision enjoining four provisions of the immigration law. Customer service goes online | China business news

Imagine this: You post a micro blog complaining about a company?s service and, although normally only your family and friends would pay attention to it, the company replies to your micro blog and apologizes in just 10 minutes.

With the appearance of new media, more companies are finding that their customer services should not be limited to stores or call centers, but should also expand online. The Internet has significantly changed how the world does business, even how a company carries out its customer services.

?Twelve years ago, if you wanted to complain to a company about its poor customer service, you even couldn?t find a place or person to complain to until the emergence of the customer call center,? said Li Nong, vice-president of the US-based business communications systems provider Avaya Inc (China), which was the first group of companies to bring call centers into China in the 1990s.

The Industry and Commercial Bank of China (ICBC) Ltd, the country?s biggest lender by market value, was the first company to establish a call center in China, in 1998.

The revolution in customer service has begun anew, moving the stage online. ICBC is still providing customer services by phone but has also opened a micro blog on Sina Weibo, which has attracted more than 7,000 followers.

?Customers are expecting the same quality service online and offline,? Li said. ?As a result, companies need higher awareness of complaints and faster reaction time.?

The new technology and trend require companies to keep an eye on the Internet at all times.

Zeng Zhihui, general manager of a consulting company in Beijing, purchased 12 months of broadband service costing more than 1,000 yuan ($156.25) from telecommunication company China Telecom in March. However, he found his broadband service was abruptly disconnected in April.

He called China Telecom, which replied that because his account owed China Telecom 0.1 yuan, his broadband was disconnected. In order to re-establish his Internet service, he would have to pay the 0.1 yuan online, which was impossible, or buy a charging card offline.

Zeng was unhappy about this and posted a message on his micro blog complaining about this. In just a few hours, he received many replies and comments. Shortly after, he found that his broadband was re-connected.

The company said they had seen his micro blog and temporarily reconnected his Internet for one hour so that he could pay his bill.

According to the company, China Telecom used Zeng?s situation as a case study in its internal meetings and signed a cooperation agreement with Sina Weibo to provide online customer service.

?Companies are only beginning to notice the influence of new media and they will face more challenges later on,? said Li from Avaya. In order to adapt to changing trends, Li said Avaya has developed its old call center platform into a multimedia connection center.

China?s Internet user numbers reached 485 million, of which 195 million subscribe to a micro blog service, according to statistics from China Internet Network Information Center in July.

Obama: Americans must pay fair share to cut deficit

WASHINGTON?? President Barack Obama said on Saturday that Americans need to be ready to "pay their fair share" to narrow the deficit, previewing his proposals to Congress that are expected to include more taxes on the rich.

In his weekly radio and video address, the Democrat said his $447 billion jobs plan that features tax breaks for workers and small businesses, plus funds for public works projects and schools, "will not add to the deficit. It will be paid for."

"On Monday, I'll lay out my plan for how we'll do that -- how we'll pay for this plan and pay down our debt by following some basic principles: making sure we live within our means and asking everyone to pay their fair share."

Obama has repeatedly argued for the wealthiest Americans to face higher taxes with fewer loopholes and exceptions as part of the effort to ensure the U.S. debtload remains in control.

He is likely to float more taxes on the rich, as well as companies getting some tax breaks, in his Monday suggestions to a congressional "super committee" tasked with finding at least $1.2 trillion in budget savings over 10 years.

Republicans, who have raised the volume on Washington's fiscal problems as the November 2012 presidential election nears, see higher taxes on the wealthy as a problem for jobs, given that entrepreneurs and companies would be strongly affected.

In his party's weekly address, Republican Congressman Peter Roskam said Obama's barnstorming about the jobs bill had masked other constraints on the economy that are keeping people from getting back to work.

"Washington has become a red tape factory, with more than 4,000 rules in the pipeline -- hundreds of which would cost our economy more than $100 million each annually," Roskam said.

The White House has conducted a regulatory overhaul to eliminate old and overlapping rules across U.S. government agencies. It was broadly welcomed by the private sector including major groups like the U.S. Chamber of Commerce.

Roskam said more regulations should be pared back as part of the effort to tackle unemployment. "I hope the president will consider our ideas as we take a look at his," he said.
